This Privacy Policy describes how Atomic Enterprises, Inc. ("Company," "we," "us," or "our") collects, uses, shares, and protects information in connection with the ByePhone service ("the Service"). By using the Service, you agree to the collection and use of information as described in this Privacy Policy. This Privacy Policy is incorporated into and subject to our Terms & Conditions.

1. Information We Collect

1.1 Account Information

When you create an account, we collect your name, email address, and phone number. If you purchase a subscription or call credits, we collect billing and payment information through our third-party payment processor.

1.2 Call Data

When you use the Service to place calls, we collect and store:

  • Phone numbers dialed
  • Call recordings (audio)
  • Call transcripts generated from recordings
  • Call metadata (duration, date, time, outcome, status)
  • AI-generated call summaries

1.3 User Content

We collect information you provide to the Service, including call instructions, business names, contact details, task descriptions, preferences, and any other content you submit.

1.4 Usage & Device Data

We automatically collect information about how you interact with the Service, including feature usage, interaction logs, IP address, browser type, device information, operating system, and referring URLs.

1.5 Cookies & Analytics

We use cookies, local storage, and similar technologies to maintain your session, remember your preferences, and collect analytics data. You can control cookie settings through your browser, though some features of the Service may not function properly without them.

2. How We Use Your Information

We use the information we collect to:

  • Provide, operate, and maintain the Service
  • Process and complete calls on your behalf
  • Generate call transcripts, recordings, and summaries for your review
  • Send you post-call updates and notifications via SMS or email
  • Process payments, manage subscriptions, and administer your account
  • Remember your preferences and improve your experience across calls
  • Improve, develop, and optimize the Service and its AI capabilities
  • Monitor for fraud, abuse, and violations of our Terms
  • Comply with legal obligations and respond to lawful requests
  • Enforce our Terms & Conditions

3. How We Share Your Information

3.1 Third-Party Service Providers

We share information with third-party service providers who assist us in operating the Service. These providers perform functions such as telephony and call routing, voice synthesis, cloud hosting and data storage, data processing, analytics, and payment processing. These providers are contractually obligated to use your information only as necessary to perform services on our behalf and in accordance with this Privacy Policy.

3.2 Legal Requirements

We may disclose your information if required by law, regulation, legal process, or governmental request, including in response to subpoenas, court orders, or requests from law enforcement.

3.3 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control.

3.4 Aggregated or De-Identified Data

We may share aggregated or de-identified information that cannot reasonably be used to identify you for research, analytics, or other purposes.

3.5 We Do Not Sell Your Personal Information

We do not sell, rent, or trade your personal information to third parties for their marketing purposes.

4. Call Recording Disclosure

All calls placed through the Service are recorded and may be transcribed using automated systems. Recordings and transcripts are stored on our servers and with our third-party infrastructure providers.

  • Recordings are used to provide you with call playback and transcripts
  • Recordings may be used to improve the quality and accuracy of the Service
  • Access to recordings is restricted to you and authorized systems
  • Transcription may involve processing by third-party service providers

You are responsible for ensuring compliance with all applicable call recording laws, including providing notice to call recipients in jurisdictions that require it. See Section 5 of our Terms & Conditions for more information.

5. Data Retention

We retain your information for as long as your account is active and as needed to provide the Service. Specific retention periods:

  • Account data: Retained while your account is active and for ninety (90) days after account deletion
  • Call recordings & transcripts: Retained while your account is active. You may delete individual recordings at any time
  • Payment records: Retained as required by applicable tax and accounting laws
  • Usage data: Retained in aggregated or de-identified form indefinitely for analytics and service improvement

We may retain information for longer periods if required by law, for pending disputes, or to enforce our Terms. After the applicable retention period, data is securely deleted or anonymized.

6. Data Security

We implement commercially reasonable technical and organizational measures to protect your information, including:

  • Encryption of data in transit (TLS/SSL) and at rest
  • Access controls and authentication requirements
  • Regular security assessments and monitoring
  • Incident response procedures

However, no method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

7. Your Rights & Choices

7.1 All Users

You may at any time:

  • Access and update your account information
  • Delete individual call recordings and transcripts
  • Request a copy of your personal data
  • Request deletion of your account and associated data
  • Opt out of non-essential communications

7.2 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act and California Privacy Rights Act, including:

  • Right to know what personal information is collected, used, and shared
  • Right to delete personal information
  • Right to correct inaccurate personal information
  • Right to opt out of the sale or sharing of personal information (we do not sell your data)
  • Right to non-discrimination for exercising your privacy rights
  • Right to limit use of sensitive personal information

7.3 European Users (GDPR)

If you are located in the European Economic Area, you may have additional rights under the General Data Protection Regulation, including rights of access, rectification, erasure, data portability, restriction of processing, and objection. 8. International Data Transfers

Your information may be transferred to and processed in the United States and other countries where our service providers operate. These countries may have data protection laws that differ from your jurisdiction. By using the Service, you consent to the transfer of your information to the United States and other jurisdictions as described in this Privacy Policy.

9. Children's Privacy

The Service is not directed at individuals under the age of eighteen (18). We do not knowingly collect personal information from children. If we become aware that we have collected information from a child under 18, we will take steps to delete it promptly. If you believe we have inadvertently collected information from a minor, please contact us immediately.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes by email or by posting a prominent notice within the Service at least thirty (30) days before the changes take effect. The "Last updated" date at the top of this page indicates when this Privacy Policy was last revised.
